Minutes of Meeting

   July 17, 2006

A meeting of the Sharon Board of Health  was called to order on Monday, July 17, 2006, at 7:45 P.M., in the Sharon Town Office Building,  with the following members in attendance: Anne Bingham, Chair, Elizabeth Barnett, Vice-Chair, Suzi Peck, Stan Rosen, and newly appointed member Jay Schwab.  Jim Andrews, Health Agent for Engineering, was also present.  Anne Bingham, Chair, and Elizabeth Barnett, Vice-Chair, arrived late.

Anniversary
It was noted that the independent, Selectmen-appointed Board of Health will celebrate its 10th anniversary on July 22, 2006.

Conservation Commission
Kathy Roth  of the Conservation Commission was present to discuss the Board of Health’s policy regarding use of alternative systems around the lake. Greg Meister, Conservation Agent, was also present for this discussion.   Suzi Peck explained the Board has not had a specific policy to require alternative systems around the lake;  further that alternative systems do not remove phosphorus, which is a problem for the lake. Suzi Peck reviewed that compliance with separation to groundwater is the first concern; then side setbacks.  Ozonation is required if these requirements cannot be met.. Re I/A systems: it was noted that some homeowners have not properly maintained their systems....or informed new homeowners of system requirements. It was explained that the board won’t require I/A systems if equal environmental protection can be attained without the I/A system.  Jim Miller, P.E., stated his agreement, noting that I/A systems are more complex and require additional maintenance.  Jim Andrews noted that, in Zone II s when expansion of property is planned, alternative systems have been required.

Variance Request - 75A Beach Street
Jim Miller, P.E., and Nelson Brenner, homeowner, re variance request for 75A Beach Street... replacement for a failed system. System designed with heavy duty 2 compartment tank; 2 bedroom design.  According to Anne Bingham, since there are 3 properties at this location under the same ownership, this should be designed as one system, not just for the one property in failure. The variance request was continued.

Variance Requests (continued)....70, 72, 74-76 Cedar Street
Jim Miller, P.E., and property owner Howard Glaser, re variance requests as previously presented. Anne Bingham recused herself from this discussion.

VOTED:(Barnett/Peck) Barnett, Peck, and Rosen voted in the affirmative; Bingham and Schwab recused themselves; to  approve setbacks per letter dated July 9, 2006, with the changes suggested by Jim Andrews and pending Jim Andrews’ approval of new plans. There will be deed restrictions to limit #72 to one bedroom, with the other properties restricted to 2 bedrooms each.  Water conservation devices will be required; any new owner must be provided with a copy of the variance.  
Once the new plan is drawn up, the BOH will be provided with the revised distances (as discussed) in detail for each property....and these will also be shown on the plan.  The Board’s approval letter will then be sent (following Jim Andrews’ approval of plans.).          

Sharon Heights Shopping Center
Ron Tiberi, P.E., Alan Gottlieb of Hinckley, Allen, and Snyder, and Larry Needle, property owner, re variance requests for Sharon Heights Shopping Center repair. Board of Health as-builts show 7800 gpd design flow.  Mr. Tiberi provided clarification received from DEP indicating that the design flow for an upgraded system of 9440 gpd should not be considered new construction.  data on actual water meter readings for the past two years are approximately 2400 gpd. One variance requested..as shown on plan. [Formerly 7.03(2)...now 7.18(2)].  Mr. Gottlieb indicated that the system capacity will be four times greater than the actual flow. A tight tank will be installed for the beauty salon.  A 2nd tight tank will be required for the laundry in the cleaning establishment (industrial discharge).  

VOTED: (Bingham/Rosen) unanimously to approve plans dated 7/11/06 for Sharon Heights Shopping Plaza, with setbacks for tank and force main to property lines as noted on the plans; the washing machine flow must be brought up to code....BOH must be notified of the resolution of this issue by September 1st; industrial wash must be removed from septic discharge and be brought up to code by Nov. 30th;  the property owner will be responsible for ensuring the tight tank is properly maintained and pumped; all grease traps must be regularly maintained and pumped.
The tertiary treatment for laundry will require a discharge permit from BOH and DEP: (tight tank or closed loop system). Regular Title 5 components must be maintained and pumped annually.     :
        
Paul Lauenstein
Paul Lauenstein discussed his concerns re herbiciding of roads in Sharon by Mass. Highway.  He
provided sample letter of concern which he asked that the Board send to Secretary Cogliano of the Executive Office of Transportation. Jay Schwab and Stan Rosen asked what herbicides are being used in Sharon; are these being detected in water supply?  Stan Rosen stated he was not comfortable in going forward with this letter based upon a request from the Hilltown Anti-herbicide Coalition. Anne Bingham stated she would contact MAHB for some facts and clarification. She would then contact BOH members for a general consensus...and would let Paul Lauenstein know of the decision.  

Waiver of Lifeguard Requirement
VOTED (Barnett/Peck) unanimously  in favor of waiving the requirement for a lifeguard for the pools at Sharon Green Condominiums.

Suzi Peck - Variance from Food Code
Suzi Peck spoke (not as a BOH member) on behalf of the Unitarian Church. She explained that the church’s annual bean supper is scheduled for the 2nd Saturday in September. She reviewed that the revised Food Code requires all non-profits to be licensed by the Board; beans are a “potentially hazardous food” and, as such, are only to be prepared in a licensed food service facility.  She stated that she had reviewed the Food Code and found that there is a variance procedure. She explained that she had spoken with both Linda Rosen and Sheila Miller regarding the possibility of the Board granting a variance for the bean supper, and that both were opposed to this proposal.  Sheila Miller was concerned about precedent setting.  Preparing the beans in a licensed food service facility was suggested. Linda Rosen stated that the Health Department had notified all non-profit organizations of the Food Code changes last winter.  Anne Bingham stated that she had no objection to looking at a variance request.  Suzi Peck will prepare a HACCP in conjunction with the variance request. Since the next Board of Health meeting is not scheduled until August 21st, it was agreed to hold a special meeting to review this request on July 24th.  Suzi Peck agreed that another representative from the Unitarian Church would make the request.
